These Terms of Service ("Terms") govern access to and use of NodePen, a web-based platform for running, sharing, and collaborating on Grasshopper scripts, provided by NodePen Ltd ("NodePen," "we," "us"), a company registered in England and Wales (company number 17257213). By creating an account or otherwise using the Service, you agree to these Terms.
You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have permission from a parent or guardian to use the Service and that they have read these Terms on your behalf.
Accounts are held by individuals. An account may be associated with one or more Teams. You are responsible for keeping your login credentials secure and for activity that occurs under your account. You must provide accurate information when creating an account.

We may also offer bespoke plans or dedicated infrastructure under a separate written agreement, which governs in the event of any conflict with these Terms.
4.2 Payment. Subscriptions are billed and processed through Stripe. By subscribing, you agree to Stripe's terms in addition to these.
4.3 Downgrades. If you downgrade a subscription, the change takes effect at the end of your current billing term.
4.4 Failed Payment. If a payment fails, you have a three-week grace period to resolve it, during which we will notify you in-app. If payment is not resolved within that period, your Team will be demoted to the next applicable tier.
4.5 Subscription Lapse. If a Team's subscription lapses, all assets remain viewable by Team members. Editing is restored once the subscription is brought current, or once the Team is reduced to a single member.
4.6 Cancellation and Refunds. You may cancel at any time. Cancellation stops future renewal; your tier remains active until the end of the current billing period, after which Section 4.5 applies. Except as required by law, fees are non-refundable.
5.1 Ownership. You retain ownership of the scripts, models, and other content you create or upload ("Content"). These Terms grant only the licenses described below.
5.2 Private Scripts. Content you keep private is restricted to members of the owning Team. You grant NodePen a license to host, store, and run private Content solely to operate the Service for your Team. Any access to a Private Script by a party outside the Team — whether or not authorized — does not, by itself, grant that party any license to use, reproduce, or commercially exploit the script.
5.3 Public Scripts. When you make a script public, you grant NodePen a license to host, run, and publicly display it, and you grant other users a license to view it, create copies of it (including downloading it for offline use), and execute those copies. Public scripts may be used commercially. There is a single license scope for public scripts; it is not configurable per script.
5.4 Copies. Using "Save a copy" creates an independent copy of a script with no attribution to, and no ongoing link with, the original. Copies persist independently of the original, including if the original script or its Team is later deleted.
5.5 Team Ownership. Content created within a Team is owned by the Team, not by the individual member who created it. If a member leaves a Team or leaves the firm, the Team retains access to and ownership of that Content.
5.6 Account and Team Deletion. You must leave or delete all Team associations before deleting your account. If you leave a Team, Content you contributed remains with the Team. If a Team is deleted, its Content is deleted and is no longer visible or accessible, even if it was previously public. Independent copies made under Section 5.4 are unaffected.
5.7 Takedown Notices. If you believe Content on NodePen infringes your rights, contact support@nodepen.io with a description of the material and the basis for your claim. We may remove or disable access to Content in response to a valid notice and may notify the affected user.
When you run a script, NodePen retains the resulting solution, the version of the document that produced it, and any models you uploaded as inputs.
While your account and the relevant document remain active, this data is linked to your account and retained for the purposes of maintaining service quality, preventing abuse and fraud, resolving disputes, and product development, including aggregate and statistical analysis. You may request deletion of this data by contacting support@nodepen.io, and we will evaluate the request against these purposes and applicable law.
When you delete your account or a document, we remove the connection between this retained data and your identity. We may keep this anonymized data indefinitely to improve NodePen over time.

The Service is provided "as is." NodePen does not warrant that solutions, geometry, or other outputs generated through the Service are correct, complete, or fit for any particular purpose. As with Grasshopper itself, you are responsible for verifying the correctness of anything you build — particularly before relying on it for structural, fabrication, code-compliance, or other safety-relevant purposes.
To the extent permitted by law, NodePen's total liability arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months before the claim arose — which is zero for anyone on the Free tier. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law. NodePen is not liable for indirect, incidental, or consequential damages.
You may export your Content at any time while your account and Team access remain active.
We may suspend or terminate your access for violating these Terms, including Section 7, or for non-payment beyond the grace period in Section 4.4. You may stop using the Service and delete your account at any time, subject to Section 5.6.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
